1. Introduction
This Privacy Policy explains how Akaviri Ltd ("Akaviri", "we", "us" or "our"), a company registered in England and Wales and trading as Capacify, collects, uses and protects information when you use the Capacify mobile application, the Capacify website, or visit a venue where Capacify capacity sensing is installed (together, the "Service").
Capacify shows how busy participating venues are, in real time, as a coarse indication (for example "Quiet" or "Busy"). It is designed so that we can do this without identifying, tracking or profiling anyone. Section 4 explains what the venue sensing collects.
By using the Service you agree to the collection and use of information in accordance with this Privacy Policy.
2. Definitions
- Company / We / Us / Our refers to Akaviri Ltd, trading as Capacify.
- Country refers to the United Kingdom.
- Service refers to the Capacify mobile application, the Capacify website (capacify.me), and the Capacify capacity sensing installed at participating venues.
- Sensor means a small device we install at a participating venue that passively listens for nearby Bluetooth Low Energy (BLE) radio signals in order to estimate how busy the venue is.
- Venue / Business means a business that has a Sensor installed and/or is listed in the Service.
- Personal Data means any information relating to an identified or identifiable individual.
- You / User means an individual using the app or website, or a visitor to a Venue.
3. Information We Collect Through the App and Website
We collect only the information necessary to operate and improve the Service.
3.1 Account Data
If you sign in to the app, we may collect:
- Name (as provided by Apple or Google)
- Email address (if shared via Apple or Google sign-in)
- Authentication identifiers from Apple Sign-In or Google Sign-In
- A push-notification token, if you enable notifications
We do not collect passwords or access your social media accounts beyond authentication. Browsing capacity information on the website does not require an account.
3.2 Location Data
The app may request access to your device's location to show nearby venues or offers.

- We do not store precise location data
- You can enable or disable location access at any time through your device settings
3.3 Usage Data
We may collect limited technical data automatically, such as:
- Device type and operating system
- App or website usage information (e.g. feature interactions, pages viewed)
- Approximate location derived from IP address, where applicable
This data is used for analytics, troubleshooting and improving the Service.
3.4 Business Data
Venues using the Service provide information about the business, including:
- Business name, category and location
- Opening times and capacity
- Offers and promotions
- Cover images or other uploaded media
- A contact number for the venue owner or manager, used to coordinate installation and calibration
Business profile information is intended to be public within the Service. Owner contact details are not published.
4. Venue Capacity Sensing
At participating Venues we install a small Sensor that estimates how busy the venue is by passively detecting the presence of nearby Bluetooth-enabled devices. It does not use a camera or microphone, does not connect to your device, and does not identify you.
- Anonymous by design. Any device identifier is anonymised on the Sensor itself, immediately, and is never stored by us or sent to our servers.
- Counts only. The only information that leaves the venue is an aggregate count of devices present over a short time window (for example "22"), which we use to estimate occupancy and display it as a coarse band such as "Quiet" or "Busy".
- No tracking. Because no identifiers are kept, we cannot recognise your device across visits or track you between venues.
- Retention. Aggregate counts and capacity estimates are kept as anonymous statistics so that venues can see typical patterns over time.
We rely on our legitimate interests in providing accurate, privacy-preserving capacity information. If you would prefer not to be counted at all, turning off Bluetooth on your device prevents it being detected. Participating Venues are asked to display a notice that Capacify capacity sensing is in use, with a link to this policy.
5. How We Use Your Information
We use the collected information to:
- Provide and operate the Service, including live capacity estimates
- Authenticate users via Apple or Google
- Display relevant venues and offers
- Enable users to activate and redeem offers
- Calibrate and maintain Sensors at Venues
- Improve app, website and estimate accuracy and performance
- Provide customer support
- Detect and prevent technical or security issues
We do not sell personal data.
6. Legal Basis for Processing
Where applicable under UK or EU data protection law, we process personal data based on:
- Your consent (for example, for location access or push notifications)
- Performance of a contract (providing the Service to you or a Venue)
- Legitimate interests (improving and securing the Service; anonymous capacity sensing)
7. Data Retention
We retain personal data only for as long as necessary to:
- Provide the Service
- Comply with legal obligations
- Resolve disputes
- Enforce our agreements
You may request deletion of your account and associated personal data at any time. Sensing data is described in section 4.
8. Data Transfers
Your information may be processed in the United Kingdom or other locations where our service providers operate.
We take reasonable steps to ensure appropriate safeguards are in place to protect your personal data.
9. Disclosure of Personal Data
We may disclose personal data only when necessary:
- To comply with legal obligations
- To protect the rights, safety, or property of users or the public
- In connection with a merger, acquisition, or asset sale, in which case users will be notified
10. Service Providers
We may use trusted third-party service providers to support the operation of the Service, such as hosting, analytics, error monitoring or authentication providers (including Apple and Google).
These providers may access personal data only to perform services on our behalf and are required to protect it.
11. Security
We take reasonable technical and organisational measures to protect your personal data, including anonymisation on-device, encrypted transport, and access controls on our systems. However, no method of transmission or electronic storage is completely secure.
12. Children's Privacy
The app is not intended for children under the age of 13, and we do not knowingly collect personal data from children. Venue sensing does not identify anyone, of any age. If we become aware that personal data of a child has been collected, we will delete it.
13. Your Rights
You have the right to:
- Access your personal data
- Request correction of inaccurate data
- Request deletion of your data
- Object to processing based on legitimate interests
- Withdraw consent where applicable
- Lodge a complaint with the Information Commissioner's Office (ico.org.uk)
To exercise these rights, please contact us using the details below. We aim to respond within 30 days. Please note that because sensing data is anonymous and aggregated, we are unable to locate or delete data relating to a specific individual from it.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Any changes will be posted within the Service or on our website, along with an updated effective date.
