• Country refers to the United Kingdom.
• Service refers to the Capacify mobile application.
• User means an individual who uses the Service to view businesses and redeem offers.
• Business means a business owner or representative who uses the Service to list their venue and post offers.
• Offer means a promotion, discount, or deal posted by a Business through the Service.
• Content means any information, text, images, or other materials uploaded to the Service.

You must be at least 13 years old to use the Service. By using the Service, you confirm that you meet this requirement.

4. Account Registration

To access certain features, you must sign in using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You agree to:

• Provide accurate information during sign-in
• Not share your account credentials
• Notify us immediately of any unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Use of the Service

5.1 For Users

Users may use the Service to:

• Browse businesses and view real-time crowd levels
• Discover and activate offers posted by Businesses
• Redeem offers at participating venues

Users agree not to:

• Misuse or attempt to fraudulently redeem offers
• Use the Service for any unlawful purpose
• Interfere with the operation of the Service

5.2 For Businesses

Businesses may use the Service to:

• Create and manage a business profile
• Post offers and promotions for Users
• Update business information such as opening times and descriptions

Businesses agree to:

• Provide accurate and up-to-date information
• Honour all offers posted through the Service
• Not post misleading, false, or deceptive offers
• Comply with all applicable laws and regulations

We reserve the right to remove any Business or Offer that violates these Terms.

6. Offers and Redemptions

Offers are created and managed solely by Businesses. We do not guarantee the availability, accuracy, or quality of any Offer.

• Offers may be subject to additional terms set by the Business
• Offers may have limited availability or expiry dates
• We are not responsible for disputes between Users and Businesses regarding Offers

Users are responsible for verifying Offer details with the Business before redemption.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. User Content

By uploading Content to the Service, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that Content in connection with the Service.

You are solely responsible for any Content you upload and confirm that:

• You own or have the necessary rights to the Content
• The Content does not infringe any third-party rights
• The Content does not violate any applicable laws

We may remove Content that violates these Terms without notice.

9. Prohibited Conduct

You agree not to:

• Use the Service in any way that violates applicable laws
• Attempt to gain unauthorised access to the Service or its systems

We are not responsible for the actions, products, or services of any Business listed on the Service.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service
